Cancellation & Refund Policy
Effective date: June 1, 2026
This policy explains cancellations, the right of withdrawal, and refunds for Services provided by Studio Marketing Italia S.r.l.s., VAT No. 18254111000. It forms part of, and should be read with, our Terms of Service.
3.1 Nature of Our Services
Most of our Services are custom, bespoke digital work — software, applications, websites, dashboards, branding, and tailored systems — produced specifically to each Client's requirements and specifications. Because this work is personalised and resources are committed as soon as an engagement begins, it is generally non-refundable once work has commenced, subject to the mandatory consumer rights described in Section 3.4.
3.2 Custom and Project Work — No Refunds Once Work Has Begun
- Deposits and milestone payments are non-refundable once the corresponding work has begun; they secure our time, scheduling, and resources.
- If you cancel a project after work has started, you remain liable for all Services performed and costs reasonably incurred up to the cancellation date. Any prepaid amount that relates to clearly separable future milestones not yet started may, at our discretion, be refunded or credited after deducting costs already incurred and a reasonable charge for work done.
- Completed and delivered work is non-refundable.
3.3 Subscriptions and Retainers
- Recurring subscriptions and retainers renew automatically and may be cancelled at any time with effect for future billing periods. To cancel, email info@studiomarketingitalia.it before your next renewal date.
- Cancellation stops future charges. Fees already paid for the current and previous periods are non-refundable, and you retain access to the relevant Service until the end of the period already paid for.
3.4 Right of Withdrawal for Consumers (EU / Italy)
If you are a consumer (acting outside your trade, business, or profession) and you concluded the contract online or at a distance, you have a statutory right of withdrawal of 14 days under the EU Consumer Rights Directive (2011/83/EU) and Italian Legislative Decree No. 21/2014, without giving any reason. The period runs from the day the contract is concluded (for services and digital content).
How to withdraw: inform us of your decision by a clear statement before the 14-day period ends, by emailing info@studiomarketingitalia.it (you may use the model withdrawal form available on request). We will acknowledge your request promptly and refund any amounts due using the same payment method, without undue delay.
Important exceptions (when the right of withdrawal is lost or does not apply):
- Services begun with your consent: if you expressly request that we begin providing the Service during the 14-day period and acknowledge that you will lose your right of withdrawal once the Service is fully performed, you lose the right of withdrawal upon full performance. If you withdraw after performance has begun but before it is complete, you must pay an amount proportionate to the Services provided up to that point.
- Custom / personalised work: the right of withdrawal does not apply to the supply of goods or services made to your specifications or clearly personalised (Art. 59 of Legislative Decree No. 21/2014).
- Digital content: for the supply of digital content not on a tangible medium, the right of withdrawal is lost once performance has begun with your prior express consent and acknowledgment that you thereby lose the right.
Business clients (B2B): the statutory right of withdrawal applies only to consumers. Clients contracting for business purposes are not entitled to the 14-day withdrawal right and are governed by Sections 3.1–3.3 and the Terms of Service.
3.5 Disputes and Chargebacks
If you believe a charge is incorrect or you are dissatisfied, please contact us first at info@studiomarketingitalia.it so we can resolve it quickly. Initiating a chargeback or payment dispute without first contacting us, in circumstances where no refund is due, may be treated as a breach of the Terms, and we reserve the right to contest it with evidence of the agreed Services.
3.6 How Refunds Are Made
Where a refund is due, it is issued to the original payment method via the original payment processor (Stripe, PayPal, or Revolut), normally within 14 days. Processing times by your bank or provider may vary.
